Terms of Service Addendum: Consent to SMS Messaging

UpShot POS (a subsidiary of Alante Credit Card Acceptance Technology LLC) may offer you the option to receive text messages on your mobile device. By providing your mobile phone number and opting in to receive text messages from us, you agree to the following terms:

1. Scope of Consent

By providing your mobile phone number, you consent to receive text messages from UpShot POS and our partners for the following purposes:

  • Sales Receipts: A digital copy of your sales receipt following a transaction.

  • Order Confirmations: Confirmation of orders placed through our platform.

  • Appointment Reminders: Reminders for scheduled appointments.

  • Waitlist Notifications: Notifications related to your position on a waitlist for reservations (if applicable).

2. Method of Consent

Your consent to receive SMS messages is obtained when you enter your phone number into the designated field on our point-of-sale system, website, or application, where the following message is displayed directly below the keypad:

"Enter your phone number to receive your receipt via text message. Message and data rates may apply."

By entering and submitting your phone number, you acknowledge that you have read and understood this disclosure and agree to receive text messages from UpShot POS for the purposes outlined above.

3. Message and Data Rates

Message and data rates may apply to each text message sent to or received by you, as provided in your mobile service rate plan. UpShot POS does not impose a separate fee for sending text messages; however, you are responsible for any fees or charges assessed by your mobile carrier. Check with your mobile carrier for details.

4. Opt-Out Instructions

You may revoke your consent to receive text messages from UpShot POS at any time. To stop receiving text messages, reply to any message you receive from us with the word "STOP". After sending "STOP," you will receive a confirmation message that your request has been processed, and you will no longer receive text messages from UpShot POS unless you subsequently opt back in.

As mobile terms and conditions evolve, please check with your mobile carrier.

UpShot POS is committed to protecting your privacy. Your phone number and any related information will be used solely for the purpose of sending you text messages as described in this consent. We will not share your information with third parties for marketing purposes without your explicit consent. Please review our Privacy Policy for more information about how we collect, use, and protect your personal information.

 Third-Party SMS Services

You acknowledge and agree that UpShot POS utilizes third-party service providers to deliver SMS messages. While we strive to ensure reliable and timely delivery of messages, UpShot POS is not responsible for any operational errors, malfunctions, or disruptions in SMS delivery caused by these third-party services.

UpShot POS will not be liable for any delays, failures, or inaccuracies in messaging, nor for any misinformation transmitted through SMS services provided by these third parties.

 

9. Modifications to this Consent

UpShot POS reserves the right to modify this consent at any time. We will post the updated consent on our website and notify you of any material changes. Your continued use of the Services after any such changes constitutes your acceptance of the new consent.

UpShot POS presents these third-party SMS products and services to its merchants as a convenience. UpShot POS merchants are solely responsible for adhering to the terms and conditions, acceptable use policies, and any other requirements imposed by these third-party providers.

Any misuse, improper use, or violation of the terms of these third-party SMS products and services by a UpShot POS merchant is the sole responsibility of that merchant. UpShot POS assumes no liability for merchant actions or omissions related to the use of third-party SMS services.
